1. License Grant
Subject to the terms of this EULA, Pothole Positioning System grants you a limited, non-exclusive, non-transferable license to use the PPS application on your devices for personal, non-commercial purposes.
2. Intellectual Property Rights
The PPS application, including all content, features, and functionality, is owned by PPS and is protected by copyright, trademark, and other intellectual property laws. You may not modify, reproduce, distribute, or create derivative works based on the application.
3. Data Collection and Privacy
By using PPS, you consent to:
- Collection of location data for pothole reporting
- Storage of user-submitted reports and content
- Processing of device sensor data in driver mode
- Usage analytics for service improvement
4. Acceptable Use
- You must be at least 18 years old to use the application
- You may not reverse engineer or decompile the application
- You may not use the application for commercial purposes
- You may not transfer your license rights to any third party
5. Warranty Disclaimer
The application is provided "AS IS" without warranties of any kind. PPS disclaims all warranties, whether express, implied, or statutory, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
6. Limitation of Liability
In no event shall PPS be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the application.
7. Updates and Modifications
PPS reserves the right to:
- Update or modify the application
- Change or discontinue features
- Modify this EULA at any time
- Require acceptance of updates to continue using the application
8. Termination
This license is effective until terminated. Your rights under this license will terminate automatically if you fail to comply with any of its terms. Upon termination, you must cease all use of the application and delete all copies.
9. Governing Law
This EULA is governed by the laws of Jamaica. Any disputes shall be resolved in the courts of Jamaica, and you consent to the exclusive jurisdiction of such courts.
